At Ainia ("we","our",or"us"),the privacy of our subscribers is of the utmost importance. Thank you for taking the time to read our privacy policy (the "Privacy Policy"). This Privacy Policy sets out how we collect, use, process, store, share and disclose your personal information on www.ainia.ai (the "Website"), and mobile applications (collectively, the"Services")
As our Services also process the personal information of children, including those under the age of 13, we are also providing you with a U.S. Children’s Privacy Policy below in conjunction with verifiable consent for use of your children’s information.
By accessing and using our Services you freely and expressly consent to the collection, use, processing, storage, and disclosure of your personal information as set out in this Privacy Policy and our Terms of Service, as well as any verifiable parental consent requests presented to you at the time of children’s information collection.
Ainia is a children’s interactive learning platform that emphasizes emotional intelligence using artificial intelligence. In order to create our Services, we rely on the use of large language model technologies (‘LLM’), some of which are provided by independent third parties such as OpenAI (https://openai.com/business/). As noted below and in our Terms of Service, Ainia does not control the creation or development of these LLMs, and has limited capacity to troubleshoot any issues with the content associated with interactive responses provided to our Children Subscribers.
As Ainia is an adaptive learning tool, it is continuously improved based, in part, on the account information provided during registration. In order to optimize our Services, we request your verifiable consent to utilize the following pieces of personal information associated with children’s subscribers, as well as the additional AI and metadata listed below;
It is important to know that each question and answer interaction is used to improve the Services, both for that child’s account and with the overall Services. The interactive responses will improve over time, be more personalized, and enable the child to more quickly and easily receive the information they are requesting or interested in. As a result, the information is stored indefinitely alongside the account, and as noted below, parents can delete this information at any time.
Please note that some interactive response information may be anonymized and no longer considered to be defined as children’s personal information under any U.S. federal or state privacy law. Anonymous information may be collected for any purpose, and stored indefinitely in our systems.

Operational Uses. Ainia uses select external service providers who may process children’s personal information on our behalf. These service providers are restricted by contract from using the disclosed personal information for any purpose other than to provide services to Ainia;
Legal and Compliance Purposes.We may share information with external parties when complying with legal process (eg; subpoena), to protect our intellectual property and other legal rights, to prevent fraud or imminent harm, and to secure the use of our Services. We reserve the right to disclose information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a law enforcement order, such as a search warrant, judicial proceeding, or court order. We may also retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our Terms of Service.
Business Transactions.In the event that Ainia goes through a business transaction, such as a merger, acquisition by another company, or sale of all or a portion of its assets, bankruptcy, or other corporate change, including, without limitation, during the course of any due diligence process, subscriber information, including Personal Information, will likely be among the assets shared and transferred. Parental subscribers will be notified via email and/or a prominent notice on the Services of any completed change in ownership or materially different uses of their children’s personal information, as well as any choices they may have regarding their children’s personal information. This Privacy Policy will become binding upon the new owner of the information until amended.
Anonymous Data. We may use and disclose anonymous or aggregated information about our children’s subscribers to any external parties, including current and potential business partners/affiliates, investors, or the public, or use it for research or analytics purposes. We adhere to the definition of “anonymized data” provided by the U.S. Federal Trade Commission in Section 800.202 of the Children’s Online Privacy Protection Rule.

We will retain your subscriber information for as long as your account or inquiry is active or as needed to provide you with the website or any requested services, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your Personal Information, we may continue to retain and use aggregate or anonymous data previously collected and/or anonymize or aggregate your Personal Information. Ainia does not ‘sell’ or ‘share’ personal information for targeted or cross-contextual behavioral advertising purposes. Ainia does not ‘sell’ or otherwise ‘commercialize’ children’s personal information that requires additional disclosures or consents under state-specific privacy laws. .
Our Services may contain links to other websites or services. We do not exercise control over the information you provide, or is collected by these third party websites. We encourage you to read the privacy policies or statements of the other websites you visit.
